The following conditions constitute an Agreement that establishes the Terms of Sale of products on the electronic commerce site of the E-LUXUS Company.
The act of placing an order implies the Customer's complete and irrevocable acceptance of these Terms of Sale.

The photographs that illustrate the products are for information purposes only and are not contractually binding. The colors displayed on your screen can be different than the exact color of the item.
The Agreement is made up of the following contractual documents, listed in decreasing order of importance :

The Order Form that is made up of the Final
List of Products Desired that the Customer approves and that is completed with
the identification information about the Customer (last name, first name,
invoicing mailing address and with Customer's payment information.
Each Order Form that the Customer approves constitutes an irrevocable agreement that can only be cancelled according to the conditions specified in articles "Right of Return" and "Order Fulfillment" of these Terms of Sale.
The site's automated order registering systems will be considered as valid proof of the Sales Agreement and its date of execution.
6. Confirmation of Order by E-mail
The following contractual information will be sent to the Customer by e-mail, no later than at the moment of delivery:

Item reference numbers and key characteristics of the
products ordered;
Delivery means, by mail;
Return rights.
The Customer has ten days to return at his expense the products that he does not wish to keep. This period of ten working days starts the day the ordered products are delivered at the address indicated by the Customer in his order.
Should he wish to exercise this right of return, the Customer may either request a full refund for an item that he has returned (shipping charges for returning an item are at the Customer's expense), or he may request to exchange the item.
An order will be fulfilled no more than 30 days from the day the Customer confirms the order.
Should a product ordered no longer be available, the Customer will be informed as soon as possible and may cancel his order. In this case, the Customer may either choose a complete refund within 30 days of the day of his payment or he may choose to exchange his original order with another product.
Delivery will not be made until the Customer has confirmed the order and, unless otherwise specified on the Order Form, full payment has been made. As such, the relevant financial institutions must approve payment. Should these financial institutions refuse payment, the order will be automatically cancelled. Moreover, the E-LUXUS Company reserves the right to refuse any orders placed by a Customer with whom it is in litigation.
Items ordered will be delivered to the address that the Customer has indicated on the Order Form. As such, the Customer agrees to accept delivery of the products he has ordered. Should the Customer not be present at the first time a delivery is attempted, a message will be left indicating either the nearest pick-up location or instructions for setting up a delivery time.
Upon delivery of the order, the Customer should check the condition of both the shipment packaging and the items ordered. In the event of any irregularities or damage, the Customer has three days from the day of delivery to record this information on the shipping company's Delivery Bill and to inform the E-LUXUS Company Customer Service Department by e-mail or by fax:

This contact information should also be used in the event a product is defective or does not correspond to the order. In this case, the E-LUXUS Company Customer Service Department will either find a solution to the problem or refund the item.
Prices are indicated in US Dollars converted in Euros, including the shipping charges. The prices indicated in Euros are for information purposes only. The conversion into Euros will not affect the validity of this Sales Agreement.
The prices are those indicated the day the order is placed.
For all deliveries made outside of the territory of the European Union, the Customer bears sole responsibility to verify that the items he has ordered may be imported into the country where delivery has been requested. Unless otherwise indicated on the Order Form, the Customer bears sole responsibility for any customs taxes or other formalities.
The credit cards accepted are indicated on the site.
The personal information requested from the Customer is necessary in order to process his order and could be transmitted to the E-LUXUS company contracted partner companies.
In accordance with the French Law of January 6, 1978 on "Information Technology and Freedom", the Customer has the right to prevent the transmission of this information and to access, change, correct and delete any information retained concerning his person. The E-LUXUS Company guarantees that the methods and standards of encryption used have been authorized or declared valid in accordance with current laws.
14. Electronic Signature - Proof
The Customer's confirmation, which authenticates and protects all messages in the Order Form, will be considered as an electronic signature with the same value between the Parties as a handwritten signature.
The computer records which are stored in reasonable conditions of security in the computer systems of the E-LUXUS company will be considered proof of all communication, ordering and payment that takes place between the Parties.
The storage of Order Forms and Invoices will be assured using a reliable and irreversible means of storage to preserve a faithful and lasting copy, in accordance with article 1348 of the Civil Code of France.
15. Full Application of Agreement
Should any one condition of this Agreement be declared inapplicable for whatever reason, such inapplicability will not affect the applicability of all other conditions of the Terms of Sale, and the condition in question will be replaced by a new one that matches the original as closely as possible.
Neither the E-LUXUS company nor the Customer will be held responsible for any obligation of this Agreement that cannot be kept due to a cause beyond its control, including wars, riots, uprisings, transportation disruptions, import or export problems, strikes, lock-outs, shortages, fires, earthquakes, storms, floods, or any other Force Major.
Similarly, the E-LUXUS Company cannot be held responsible for how ordered and delivered products are used. The Customer bears sole responsibility for how ordered products are used by himself or by others.
This Agreement is subject to the laws of France.
Any dispute or disagreement will be within the sole competence of the Court of Lyon.
